What Is Carjacking?

Carjacking is a serious crime that involves taking a motor vehicle from another person using force, fear or intimidation. According to Florida Statute 812.133, carjacking is defined as:

  • The taking of a motor vehicle from the person or the custody of another
  • With the intent to either temporarily or permanently deprive the person or the owner of the vehicle
  • During the taking, a person uses force, violence, assault or the placing of someone in fear

Carjacking crimes can include armed carjacking, aggravated carjacking and carjacking with a firearm.

Understanding The Penalties For Carjacking

A conviction for carjacking comes with severe penalties. In Florida, carjacking is a first-degree felony, punishable by a mandatory minimum prison term of 21 months, a maximum prison sentence of 30 years and potential fines reaching $10,000. Additionally, Florida’s 10-20-Life Statute may apply, which can lead to even harsher penalties if a firearm was involved in the commission of the crime.

What Is The Difference Between Carjacking And Grand Theft Auto?

While both carjacking and grand theft auto involve taking a motor vehicle without the owner’s consent, there’s a key difference between the two crimes. Grand theft auto, also known as motor vehicle theft, typically involves taking a vehicle without the use of force or fear. In contrast, carjacking involves taking a vehicle from a person using force, fear or intimidation. Grand theft auto is a third-degree felony, punishable by fines of up to $5,000 and up to five years in prison.
