Experienced Criminal Defense When It Matters Most

Vero Beach Prescription Drugs Criminal Defense

The state of Florida takes prescription drug crimes seriously. The penalties can be severe, impacting your freedom, finances and future. My name is Adam Chrzan, and I founded my firm in Vero Beach to serve the local community. Prior to becoming a lawyer, I was a Florida reporter, which gives me a unique insight into my caseload. I have more than 20 years of experience as a lawyer, and I previously served as a prosecutor. Now, I work for you. I make myself available to my clients 24 hours a day, seven days a week.

What Constitutes Illegal Possession Of Prescription Drugs?

Illegal possession of prescription drugs occurs when you have a controlled substance without a valid prescription. A controlled substance is a drug regulated by the government due to its potential for abuse or harm. Common examples include:

  • Oxycodone
  • Hydrocodone
  • Fentanyl
  • Amphetamines
  • Xanax
  • Adderall

Even if you had a legitimate prescription in the past, possessing the medication without a current, valid prescription may be a crime.

Drug crimes can be charged in state or federal court, depending on the circumstances. Federal drug crimes are often investigated by the Drug Enforcement Administration (DEA). If a federal agency is involved in a criminal investigation, any forthcoming charges are likely severe and so are the possible penalties if you are convicted.

What Is Prescription Drug Fraud?

Prescription fraud involves illegally obtaining prescription drugs through deceptive means. This can take many forms, including prescription forgery, where someone alters or creates a fake prescription. Doctor shopping charges can arise when a person visits multiple doctors to obtain the same or similar prescriptions without informing each doctor of the other prescriptions.

Pill mills, which are illegal operations where prescriptions are improperly issued, also contribute to prescription fraud. Florida has implemented a prescription monitoring program to track the dispensing of controlled substances and prevent prescription fraud. Prescription pad theft is also a serious crime.

Understanding The Penalties For Prescription Drug Crimes

The penalties for prescription drug crimes in Florida vary depending on the type and amount of drug involved, whether or not the crime is charged as a misdemeanor or felony, and what type of crime was committed. Examples include:

  • Misdemeanor prescription drug possession: A conviction can result in up to one year in jail and fines
  • Felony prescription drug possession: A conviction can result in up to five years in prison.
  • Prescription drug trafficking: For over four grams of opioids, mandatory minimum sentences start at three years and fines up to $50,000

In any of these instances, convictions will result in a suspension of your driver’s license.

There can be aggravating factors that increase the penalties. For example, the possession of drugs near a school, the involvement of a minor in the offense, or the use of a firearm in the commission of a crime will result in more serious consequences.
